PLEASE READ CAREFULLY. These Terms include an assumption of risk, a limitation of our liability, an indemnity you owe us, and a binding arbitration agreement with a class-action waiver (Section 14). By creating an account or using Roast, you agree to all of it. If you do not agree, do not use Roast.

1. WHAT ROAST IS

Roast is an entertainment app for comedic "roasts" — jokes, insults, and playful trash talk shared as video, photo, and text. The content is meant to be humorous. You understand you may see content that is offensive, crude, provocative, or that you personally dislike, and you choose to use the app anyway.

2. ELIGIBILITY & AGE

You must be at least 13 years old (and old enough to form a binding contract where you live; some regions require 16 or older). If you are under the age of majority, you may use Roast only with the consent and supervision of a parent or legal guardian who agrees to these Terms. We may remove accounts we believe belong to underage users.

3. YOUR ACCOUNT

You are responsible for your account, your login, and all activity under it. Keep your credentials secure and notify us of any unauthorized use. Handles and profiles must not be misleading or impersonate others.

4. ASSUMPTION OF RISK & CONSENT TO BE ROASTED (IMPORTANT)

Roast is, by its nature, a place where people insult and mock each other for laughs. By posting, replying, or otherwise participating, you knowingly and voluntarily ASSUME THE RISK of receiving roasts, criticism, mockery, embarrassment, hurt feelings, and offensive commentary directed at you or your content. You consent to receiving such content. To the fullest extent permitted by law, you RELEASE and WAIVE any claims against Roast and other users arising from lawful roasting, jokes, opinions, satire, or parody. This does not license the prohibited conduct in Section 6.

5. OWNERSHIP OF CONTENT & DATA

To the maximum extent permitted by law, Roast owns all content, posts, roasts, comments, messages, media, and all data created in or through the app ("Content & Data"). You hereby irrevocably ASSIGN to Roast all right, title, and interest — including all intellectual-property rights, and you WAIVE any moral rights — in and to everything you submit ("User Content"), effective the moment you submit it. If any such assignment is not enforceable in your jurisdiction, you instead grant Roast a perpetual, irrevocable, worldwide, royalty-free, EXCLUSIVE, transferable, sublicensable license to host, store, reproduce, transcode, modify, create derivative works from, display, distribute, monetize, and promote that content for any purpose, in any media, now known or later developed, with no obligation or payment to you. You represent and warrant that you own or control all rights necessary to grant the foregoing, and that your submissions and their subjects do not violate any law or third-party right. You remain solely responsible and liable for what you submit. Nothing in this Section limits the privacy rights described below that cannot be waived under applicable law (for example, statutory rights to access or delete your personal data).

6. PROHIBITED CONDUCT — ZERO TOLERANCE

Roast has ZERO TOLERANCE for objectionable content and abusive users. There is a line between a roast and abuse. You may NOT:

Bully, harass, stalk, or target anyone to make them feel unsafe
Threaten violence, or encourage self-harm, suicide, or violence
Post hate speech or slurs based on race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or any protected class
Post any content that sexualizes minors, or any sexual content involving minors — this is absolutely prohibited and will be reported to authorities
Post non-consensual intimate imagery, or record/post another identifiable person without their consent
Post nudity, pornography, or sexually explicit content of any kind
Post obscene, vulgar, or gratuitously profane content — keep roasts clever, not filthy
Dox, share private or personal information, or impersonate anyone
Post illegal content, infringe intellectual property, or violate anyone's rights
Spam, scam, phish, distribute malware, or run bots
Scrape, reverse engineer, or interfere with the app or its security.

7. MODERATION, SUSPENSION & TERMINATION

We may, at our SOLE DISCRETION, and to the maximum extent permitted by law, remove, hide, or restrict any content, and suspend, limit, shadow-limit, or PERMANENTLY BAN any account, AT ANY TIME, WITH OR WITHOUT NOTICE, AND FOR ANY REASON OR NO REASON, including for conduct off the platform. Access to Roast is a privilege, not a right. We are not liable to you for removing content or terminating access. You may stop using Roast and delete your account at any time.

8. REPORTING, MODERATION & COPYRIGHT (DMCA)

You can report content or users in-app on any post or profile, or email [email protected]. We review reports of objectionable content and aim to remove violating content and eject offending users within 24 hours. You can also block any user to immediately stop seeing their content and prevent them from contacting you. We respond to valid intellectual-property complaints, remove infringing content, and terminate repeat infringers; send DMCA notices with all legally required information to that address.

9. THIRD-PARTY SERVICES

Roast relies on third-party providers (for example, cloud hosting, media streaming, and database/auth services) to function. We are not responsible for third-party services, outages, or their handling of data beyond our agreements with them. Links or content from third parties are not endorsed by us.

10. DISCLAIMERS

ROAST IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT CONTENT IS ACCURATE OR APPROPRIATE. WE ARE NOT RESPONSIBLE FOR USER CONTENT OR THE CONDUCT OF ANY USER.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROAST AND ITS OWNERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR EMOTIONAL DISTRESS, ARISING FROM OR RELATED TO THE APP OR OTHER USERS' CONTENT OR CONDUCT. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100. Some jurisdictions do not allow certain limitations, so some may not apply to you.

12. INDEMNIFICATION

You will indemnify, defend, and hold harmless Roast and its owners and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the app, your violation of these Terms, or your violation of any law or third-party right.

13. CHANGES TO THE APP & TERMS

We may modify, suspend, or discontinue any part of the app at any time. We may update these Terms; material changes will be posted in-app or by other reasonable notice. Continued use after changes means you accept them.

14. DISPUTE RESOLUTION — ARBITRATION & CLASS-ACTION WAIVER

Most disputes can be resolved by emailing us first, and you agree to try informal resolution for 30 days before filing anything. Otherwise, to the extent permitted by law, you and Roast agree that any dispute will be resolved by BINDING INDIVIDUAL ARBITRATION, not in court, and YOU AND ROAST WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. Arbitration is administered under the rules of a recognized arbitration provider in Camden County, New Jersey. You may opt out of arbitration within 30 days of first accepting these Terms by emailing us.

15. GOVERNING LAW & VENUE

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws rules. Subject to Section 14, exclusive venue for any permitted court action is Camden County, New Jersey.

16. GENERAL

If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may. These Terms are the entire agreement between you and Roast regarding the app.

PRIVACY POLICY

A. INFORMATION WE COLLECT

Account info you provide (handle, display name, bio, avatar, and — if applicable — email for sign-in).
Content you create (posts, roasts, comments, messages) and related metadata.
Usage and device data (app interactions, approximate diagnostics, device/OS type) to run and improve the app.

We do not intentionally collect precise location or sensitive categories of data.

B. HOW WE USE IT

To operate, secure, moderate, and improve Roast; to show your content to others as you direct; to enforce these Terms; and to communicate with you.

C. HOW WE SHARE IT

With service providers who host and process data on our behalf (cloud, media streaming, database/auth), under confidentiality obligations.
To comply with law, respond to legal requests, or protect rights, safety, and the integrity of the app.
We do NOT sell your personal information.

D. RETENTION & DELETION

We keep data while your account is active and as needed for legal, safety, and operational purposes. You can request deletion of your account and content by emailing [email protected]; some records may be retained where the law allows or requires.

E. SECURITY

We use reasonable measures to protect your data but cannot guarantee absolute security.

F. CHILDREN

Roast is not directed to children under 13, and we do not knowingly collect their data. If you believe a child provided us data, contact us and we will delete it.

G. YOUR CHOICES & RIGHTS

Depending on where you live, you may have rights to access, correct, delete, or export your data, or to object to certain processing. Contact us to exercise them.

H. INTERNATIONAL

Your data may be processed in countries other than yours, which may have different data-protection laws.

We may update this Privacy Policy; material changes will be posted in-app.
